Terms of Service

1. Acceptance of Terms

By creating an account or using Defy Daily ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Your use of the Service is also subject to our Privacy Policy andHealth & Wellness Disclaimer.

2. Description of Service

Defy Daily is a personal mastery and wellness application that provides mood tracking, journaling, habit tracking, sobriety tracking, self-assessments, growth pathways, AI-powered reflections (SuperAgent), and optional human coaching oversight. The Service is offered in three subscription tiers as described in our Subscription Terms.

3. Not a Medical or Emergency Service

Critical Notice: Defy Daily is a wellness, self-reflection, and personal growth tool. It is not a medical device, clinical treatment, psychotherapy, emergency monitoring service, or crisis intervention service.

  • The Service does not diagnose, treat, or cure any medical or mental health condition.
  • The Service does not provide emergency response, continuous monitoring, or crisis intervention.
  • AI-generated reflections and insights are automated suggestions, not professional advice.
  • Coach responses (Premium tier) are supportive guidance, not clinical psychotherapy or medical care.
  • If you are experiencing a mental health emergency, call 911 or the 988 Suicide & Crisis Lifeline.

4. AI vs. Human Interaction

Defy Daily provides two types of guidance within the application:

  • SuperAgent (AI): Automated reflections, pattern analysis, and guidance generated by AI systems. These are clearly labeled as AI-generated within the app and do not constitute human interaction or professional advice.
  • Human Coach: Personalized responses, journal reviews, and guidance written by your designated Defy Daily coach (Premium tier only). These are clearly labeled as human-authored within the app.

You acknowledge that AI-generated content may be inaccurate, incomplete, or inappropriate, and you should not rely on it as a substitute for professional advice.

5. User Accounts & Responsibilities

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate information and keep your profile up to date.
  • You are solely responsible for the content you submit (journal entries, mood data, messages).
  • You agree not to use the Service to harm yourself or others, or to promote self-harm or violence.
  • You agree not to attempt to access other users' data or circumvent subscription tier restrictions.

6. Subscription Tiers & Billing

Defy Daily offers three tiers: Free, Standard ($5.99/month), and Premium ($29.99/month). Full details are in our Subscription Terms. Subscription fees are billed through your device's app store (Apple App Store or Google Play) and are subject to their respective payment and refund policies.

7. Account Deletion

You may permanently delete your account and all associated personal data at any time from Settings → Account → Delete Account. Account deletion is irreversible and removes all journal entries, mood logs, assessments, habit data, sobriety trackers, and coach conversations within 30 days. 8. Intellectual Property

The Service, including the A.D.V.I.C.E. framework, assessments, growth pathways, software, and design, is owned by Defy Daily and protected by intellectual property laws. You retain ownership of the personal content you submit (journal entries, reflections). By submitting content, you grant Defy Daily a license to process and display it within the Service for your use and, if applicable, your coach's review.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. Defy Daily is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to outcomes related to mental health, wellness, or personal growth decisions made based on AI-generated content or coach guidance. The Service is not a substitute for professional medical or mental health care.

10. Termination

You may terminate your account at any time by using the Account Deletion workflow. We may suspend or terminate your access if you violate these Terms, engage in harmful behavior, or if required by law. Upon termination, your right to use the Service ceases, and your data will be deleted per our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app. Continued use of the Service after changes constitutes acceptance of the revised Terms.
